THE SECRETARY-GENERAL OF THE EUROPEAN PARLIAMENT,

    having regard to the Staff Regulations of Officials of the European Union (hereinafter 'Staff Regulations'), in particular Articles 37, 38 and 46 thereof,

    having regard to Article 2 of the Bureau decision of 13 January 2014 on the delegation of the powers of the appointing authority and of the authority empowered to conclude contracts of employment (AECE),

    having consulted the Legal Service, the Data Protection Officer, the Staff Committee and the Committee on Equal Opportunities and Diversity,
HAS ADOPTED THE FOLLOWING INTERNAL RULES:

Article 1 Scope

    These rules shall apply to European Parliament officials internally seconded in accordance with the provisions of Article 37(a), second indent, of the Staff Regulations.

Article 2 Grading in the secondment post

    1. Seconded officials subject to these rules shall be placed either in the same grade as that of their main career or in a higher grade.

    2. Officials classified in the same grade shall retain the seniority in grade and step which they have acquired as an official.

    Officials seconded to a higher-grade post shall be graded in accordance with Article 46 of the Staff Regulations.

Article 3 Grading following promotion

    In accordance with Article 38(f) of the Staff Regulations, a seconded official who is promoted in his or her career in the General-Secretariat to a grade higher than that at which he or she is seconded shall be reclassified in the higher grade in the secondment post with effect from the date of promotion in the General-Secretariat.

Article 4 Transitional provisions

    A temporary staff member who was appointed an official by 31 December 2013 at the latest and who is seconded at the same grade as he or she had before being appointed an official shall retain the seniority in grade and step acquired under contract as a temporary staff member if his or her grading as an official is lower than the secondment grade.

Article 5 Final provisions

    These rules shall enter into force on the first day of the month following that in which they are signed.
